Algorithmic Award. Any award in which an AI materially contributed to reasoning or outcome.
Prompt Contamination. When an AI system uses data from one proceeding in another—raising confidentiality and cross-case bias risk.
Model Drift. The danger that model updates change outputs for the same prompt over time.
Hallucination. AI generating fabricated facts, spurious citations, or invented legal principles.

Arbitrus.ai illustrates both the promise and the challenge of AI in arbitration: efficiency and accessibility on one hand, and the untested questions of legitimacy, transparency, and enforceability on the other. It reminds practitioners that the future of dispute resolution is not abstract becasuse it’s already being coded.
4. Drafting the AI Arbitration Clause
Drafting an AI clause is a balancing act: too vague, and you get uncertainty; too rigid, and you lock parties into obsolete tech.
A. The Specificity Dilemma
A clause saying “the tribunal may use AI tools” offers no guidance or accountability. One saying “the tribunal must use GPT-4 version 2024-03-15” will age badly or become inapplicable when the vendor discontinues the model.
A pragmatic middle path is to define capability standards rather than fixed models. For example, requiring a “reasoning-capable large language model with minimum 200K token context and documented bias testing.” Then permit upgrades by mutual consent, with version controls.

- Identification of a model family or baseline capability
- Version control or upgrade protocols

8. Looking Ahead: Governance, Legitimacy, and Opportunity
The integration of AI into arbitration is inevitable. The key question is whether practitioners, institutions, and courts will set guardrails or let the practice evolve invisibly.
Institutions can lead with model clauses, arbitrator training, explainability and audit standards, and certification of “arbitration-ready” systems. National legislators can clarify the permissibility of AI adjudication and set disclosure rules, particularly for consumers and employees. International bodies might eventually produce soft-law or model-law guidance.
Legitimacy matters. If parties feel they are judged by opaque machines, arbitration loses credibility. Transparent, auditable, human-overseen AI can enhance rather than erode confidence.
The most practical path is a hybrid. AI produces preliminary analyses and drafts; human arbitrators test, revise, and own the result. That preserves party autonomy, captures AI’s efficiencies, and aligns with enforcement expectations.
9. Conclusion: The Freedom Test for Arbitration
Arbitration’s defining virtue is procedural freedom. AI is testing how far that freedom can stretch. We can allow AI to evolve in the shadows, or we can shape it with principled drafting, robust oversight, and institutional governance.
AI will not replace human arbitrators tomorrow. But it is already forcing us to clarify what judgment means in private dispute resolution. If we act now with transparency and care, we can retain arbitration’s legitimacy while harnessing AI’s promise.

Parties should remain free to decide how they contract with one another. If both sides agree to let AI decide their disputes, that choice should be respected. I recognize this approach opens a range of new and complex questions that few have explored. It may quickly become more complicated than either party anticipates. That is why lawyers drafting such clauses must understand this new frontier in arbitration and advise their clients carefully.
Early cases involving AI-driven arbitration will likely be messy, but that is how legal systems evolve. Over time, courts and arbitral bodies will clarify the boundaries, creating more predictable rules and outcomes for AI in arbitration.
